New York Power of Attorney for China: Notarization, County Certification and Apostille Processing Order

A power of attorney signed in New York is usually notarized first, and then verified by the County Clerk’s certification and New York State Apostille. The specific content should be confirmed by the Chinese recipient.

Determine the authorization matters first, and then prepare a signed version

Real estate sales, banking business, inheritance, litigation and corporate affairs have different requirements for the scope of authorization. Apostille does not review authorization content for adequacy and does not automatically make a general power of attorney applicable to all institutions. Before signing, the Chinese bank, housing authority, notary agency, court or lawyer should confirm the text, trustee information and signing method.

The common three-level sequence of notarized documents in New York

1. The client signs in front of a New York notary as required;
2. The County Clerk in the county where the notary is registered verifies the notary's signature;
3. Then apply for Apostille from the New York Department of State.

The official New York State page clearly states that notarized documents such as power of attorney usually need to be certified by the corresponding county clerk before being submitted to the State Department. Please refer to Current New York State Instructions and specific county requirements.

Information to be checked before signing

• Legal names and certificate information of the principal and trustee;
• Authorization matters, authority boundaries and validity period;
• Real estate address, bank name, company name or case information;
• Whether witnesses, fingerprints or specific Chinese formats are required;
• Whether the Chinese recipient requires original documents and complete translations.

Do not sign a blank template first

Notaries mainly verify the signing behavior or identity and do not draft legal terms for clients. When there are significant estate, litigation or inheritance consequences, the text should be reviewed by a qualified attorney. Make an appointment for signing after the content is confirmed to avoid having to complete the entire set of notarization and certification just to modify one page.
