The Declaration of the Same Person is used in China: When is it needed, how to prepare and apply for it Apostille

When the spelling of the name, previous names, or the order of Chinese and English are inconsistent, the receiving party may require the Declaration of the Same Person, but it cannot replace the official record correction.

What situations may require a One and the Same Person Affidavit?

When there are differences in pinyin, maiden name, previous name or order of names in passports, birth certificates, real estate records, bank accounts or company documents, the Chinese receiving unit may require One and the Same Person Affidavit.

Ask first if you can directly correct the original document

If there is an error in the government record itself, you should first ask the issuing authority whether it can be corrected. Same person statements are used to explain correspondence between documents and should not be used as a tool to bypass formal correction procedures.

The content of the declaration should be specific

• List the spelling of each name and which document it appears in;
• Indicate that these names refer to the declarant himself;
• Indicate the purpose and receiving unit;
• Attach necessary but not excessive supporting documents.

Signature and Certification

After the text is confirmed, the declarant completes the notarization according to the requirements of the signing state, and then handles the applicable county certification and Apostille according to the state where the notary is located. Do not sign a blank template first, and do not replace attachments after notarization.
